FleurHost SMM Panel Service Agreement

This Service Agreement applies to all Social Media Marketing (SMM) panel websites hosted, supplied, deployed, or maintained under FleurHost Philippines. By purchasing, using, renewing, or continuing any FleurHost SMM panel service, the client agrees to all terms, conditions, and policies stated on this page.

1. Nature of Service

FleurHost operates as a supplier and service provider of Social Media Marketing (SMM) panel systems. All websites hosted under FleurHost are considered FleurHost-managed SMM panel systems deployed within FleurHost infrastructure. FleurHost provides the hosting environment, system deployment, server configuration, technical setup, maintenance environment, and system management required to operate the SMM panel. The client operates the website as their business platform, but the system environment, deployment structure, hosting infrastructure, and server-side configuration remain under FleurHost management.

2. Renewal Policy

All SMM panel services must be renewed on or before the assigned due date. Failure to renew on time may result in suspension, service interruption, or permanent termination of the website service. Renewal payments must be completed before or on the due date to keep the website active and accessible.

3. Suspension Policy

If the service becomes overdue, the website may be suspended automatically or manually by FleurHost. During suspension, the website may become inaccessible partially or fully. FleurHost also reserves the right to suspend any website involved in abuse, suspicious activity, fraud reports, system abuse, security risks, or policy violations.

4. Termination Policy

If the website remains unpaid beyond the allowed grace period, the service will be marked as terminated. Once terminated, FleurHost may remove the website from the server, delete files and databases, close the service record, and release server resources without further notice.

5. Terminated Websites

Websites that are not renewed within the allowed grace period are considered terminated and abandoned services within the FleurHost system. FleurHost reserves the right to delete, archive, deny access, reuse resources, or permanently remove terminated websites and related data.

Non-renewed and terminated websites deployed under FleurHost infrastructure may be considered FleurHost property if abandoned due to non-renewal.

8. Database Copy Request

Clients may request a database copy or website files only while the website is suspended and not yet terminated. Database extraction and file preparation require administrative work and server processing; therefore, database copy requests are subject to a service charge.

9. Restoration Policy

If the website is still within the grace period, restoration may be possible after full payment of renewal and late fees. If the website is already terminated, restoration is not guaranteed. If restoration is still technically possible, the client must pay the renewal fee, restoration fee, and setup or reactivation fee.

10. Liability and Responsibility

FleurHost shall not be held responsible for internal website issues including admin misuse, internal fraud, fund theft, wrong pricing setup, incorrect API configuration, service misuse, business losses, account mismanagement, or security issues caused by shared access or weak passwords. All business operations inside the SMM panel are the responsibility of the client.

11. API Providers and Third-Party Services

FleurHost is not responsible for issues related to third-party API providers, including service delays, order failures, price changes, API downtime, or provider shutdowns.

12. Server Downtime and Maintenance

FleurHost may perform server maintenance, updates, migrations, or security work that may temporarily affect website accessibility. FleurHost is not liable for business loss due to downtime, maintenance, server issues, or network problems beyond control.

13. Backup Responsibility

FleurHost performs periodic system backups for maintenance, security, and service continuity purposes. However, clients are required and strongly encouraged to maintain their own independent backups of all important data including orders, users, balances, website content, and other system information. FleurHost shall not be held responsible or liable for any data loss, data corruption, or data unavailability caused by suspension, termination, hacking incidents, security breaches, system failures, client actions, third-party issues, or non-renewal of services.
